Nose for Leads — Terms of Service

Nose for Leads sells validated business leads on a pay-per-lead credit system. One credit buys one validated lead — a business contact whose email passed our deliverability check before you ever saw it. You only pay for leads that pass; leads that fail verification never consume a credit.

Credits never expire, have no cash value, are non-transferable, and may only be used for your own business purposes. They are not a gift card, a security, or a stored-value instrument, and we don’t sell them as one.

Nose for Leads grants Customer a limited, non-exclusive, non-transferable, non-sublicensable license to use delivered Lead Data for Customer’s internal business and outreach purposes. Lead Data is compiled from public and third-party sources and the same or similar records may be licensed to other customers. Customer may not resell, redistribute, publish, or make Lead Data available to any third party, or use it to build or train a competing product.

We don’t promise exclusivity, and we don’t claim leads that no one else has. If you want to build your own competing lead database from what we deliver, that’s the one thing this license doesn’t allow.

You’re responsible for how you use Lead Data. You agree to comply with CAN-SPAM (15 U.S.C. §7701 et seq.), the Telephone Consumer Protection Act (TCPA), and all other applicable federal, state, and local laws governing commercial communications. You will not use Lead Data for any purpose covered by the Fair Credit Reporting Act (FCRA) — Lead Data is not to be used, in whole or in part, as a factor in eligibility decisions for credit, employment, insurance, housing, or any similar purpose.

Lead Data is business contact information. You will only contact the individuals in it in a manner that relates to that person’s profession, business, or employment — not for personal, household, or consumer purposes.

If you export Lead Data, you agree to re-check it against your own suppression and opt-out lists at least once a month and to stop contacting anyone who has opted out, regardless of where that request originated.

LEAD DATA IS PROVIDED “AS IS” AND “AS AVAILABLE.” WE MAKE NO WARRANTY, EXPRESS OR IMPLIED, THAT ANY LEAD IS ACCURATE, COMPLETE, CURRENT, OR FIT FOR A PARTICULAR PURPOSE. TO THE FULLEST EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

That disclaimer is the legal position. Here’s the operational one: a lead that fails our verification check never consumes a credit in the first place — that’s mechanical, not a favor. Beyond that, if a delivered lead you were charged a credit for hard-bounces within 30 days of delivery, we’ll credit it back on request. Email support@noseforleads.com with the bounce evidence and we’ll re-credit your account.

We don’t credit back leads because you didn’t win the business, because the prospect never responded, or for leads you’ve already exported and used. The credit-back policy covers bad data, not a slow or unsuccessful sales process.

Credit packs are purchased through Stripe. All payments are final and non-refundable. The sole remedy for bad lead data is the credit-back policy above — credits, never cash.

You’re responsible for keeping your account credentials secure and for all activity under your account. If your account is terminated or you close it, leads already delivered to you remain yours to use under the license above — only platform access ends.

You agree to indemnify and hold Nose for Leads harmless from any claim arising out of your use of Lead Data, including your sending of any message in violation of any law.

To the fullest extent permitted by law, our total liability arising out of or related to these Terms will not exceed the greater of $100 or the fees you paid us in the 12 months preceding the claim. Neither party is liable for indirect, incidental, special, or consequential damages.

These Terms are governed by the laws of [Operating-entity jurisdiction — pending incorporation], and any dispute will be brought exclusively in the courts of that jurisdiction. Both parties consent to that venue.

We may update these Terms from time to time. We’ll update the date at the top of this page when we do. Continuing to use Nose for Leads after a change means you accept the updated Terms.
